റെസ്ലിംഗ് ഫെഡറേഷന്റെ നിലവിലുള്ള സെലക്ഷൻ നയത്തെ ചോദ്യം ചെയ്തുകൊണ്ട് വിനേഷ് ഫോഗട്ട് സമർപ്പിച്ച ഹർജിയിലായിരുന്നു ഡൽഹി ഹൈക്കോടതിയുടെ ഡിവിഷൻ ബെഞ്ച് താരത്തിന് അനുകൂലമായി നിർണ്ണായക ഉത്തരവ് പുറപ്പെടുവിച്ചത്. വനിതാ കായികതാരങ്ങളെ മത്സരങ്ങളിൽ നിന്ന് ഒഴിവാക്കുന്നതിനോ അവരെ പാർശ്വവത്കരിക്കുന്നതിനോ ഉള്ള ഒരു കാരണമായി ‘മാതൃത്വം’ (Motherhood) മാറരുത് എന്ന് ഹൈക്കോടതി ഫെഡറേഷനെ ഓർമ്മിപ്പിച്ചു. സെലക്ഷൻ പ്രക്രിയയിൽ പൂർണ്ണമായ സുതാര്യത ഉറപ്പാക്കാനായി സ്പോർട്സ് അതോറിറ്റി ഓഫ് ഇന്ത്യ (SAI), ഇന്ത്യൻ ഒളിമ്പിക് അസോസിയേഷൻ (IOA) എന്നിവർ നിയമിക്കുന്ന സ്വതന്ത്ര നിരീക്ഷകരുടെ മേൽനോട്ടത്തിൽ മാത്രമേ ട്രയൽസ് നടത്താവൂ എന്നും, ഇതിന്റെ പൂർണ്ണമായ ദൃശ്യങ്ങൾ പകർത്തി സൂക്ഷിക്കണമെന്നും ഹൈക്കോടതി ഉത്തരവിട്ടിരുന്നു.
രാജ്യത്തിനായി പോരാടുന്ന ഒരു കായികതാരത്തെ മാനസികമായി തകർക്കുന്ന ഇത്തരം നിലപാടുകൾ പാടില്ലെന്ന് കോടതി വ്യക്തമാക്കിയിരുന്നു. ഈ ഉത്തരവിനെതിരെയാണ് ഫെഡറേഷൻ ഇപ്പോൾ സുപ്രീംകോടതിയിൽ അപ്പീൽ പോയിരിക്കുന്നത്. നാളത്തെ സുപ്രീംകോടതി വിധി വിനേഷ് ഫോഗട്ടിന്റെ ഏഷ്യൻ ഗെയിംസ് കരിയറിൽ ഏറെ നിർണ്ണായകമാകും.
